What is an e-gift card? expand

An e-gift card is an electronic or virtual gift card, as opposed to a traditional plastic gift card, and will be sent via email to the recipients email address.

How do I use my e-gift card? expand

Once you have received your email notification with the Luna Grill Gift Card ID you are set to begin using the e-gift card.

Use it when ordering on the app by going through the usual ordering process and then on the Make Payment screen choose Pay Now. Then pick Add New Payment Method and add your e-gift card information to use it on your order.

To use your gift card at a Luna Grill restaurant, simply print your e-gift card email out and present it at any Luna Grill.

How do I redeem a gift card? expand

Are there any fees associated with purchasing an e-gift card? expand

There are no delivery or handling charges; you only pay for the face value of the e-gift card.

How can I change the value of my e-gift card purchase or cancel the transaction? expand

All virtual gift card transactions are final. If you want to increase the e-gift card value, then a new transaction will be required.

Can I send myself a virtual gift card if I want to give them to my friends, colleagues, and family? expand

Yes, you can send yourself e-gift cards. When purchasing e-gift cards, simply enter your information on the “Recipient Information” page. Once you receive the virtual gift card via email, you can either forward it to others or print it then share it.

How will the recipient know that I sent them a virtual gift card? expand

The recipient of the e-gift card will receive an email notification (if you selected this option) indicating that a virtual gift card has been sent to them. These notifications include any personal messages you added during the gift card purchase process.

How long does it take for a e-gift card to reach the recipient? expand

All gift cards purchased are subject to credit card and security processing. This typically occurs within 20 minutes however it could take up to 24 hours. If cards are not received within 24 hours please contact our customer support.

When will a traditional gift card be mailed? expand

All orders places for a physical gift card will be processed the next business day. Delivery will depend upon the option you choose. Standard delivery will be shipped via the United States Postal Service.

I didn’t want to send an e-gift card, I wanted to send a traditional plastic one. How can I send a traditional plastic gift card? expand

Unfortunately, we are unable to convert an e-gift card to a plastic one. The e-gift card can be sent to you for printing and forwarding, the same way you would forward a plastic card.

I lost my e-gift card print out. How do I request a replacement? expand

If you misplaced your virtual gift card, click on the link in the original email to access it. If you no longer have the original email, please contact the purchaser of the gift card and have them resend it to you.

Luna Grill Gift Card Terms & Conditions

Effective June 23, 2021.

These Luna Grill Gift Card Terms and Conditions include an Arbitration provision (Section 10) that governs any disputes between you and us. Among other things, this provision will eliminate your right to a trial by jury; and prevent you from bringing, joining, or participating in class or consolidated proceedings.

These Luna Grill Gift Card Terms & Conditions (“Terms and Conditions”) are made between you (as purchaser or holder of a Gift Card) and Luna Grill, a California corporation (“we” or “us”) and describes the terms and conditions that apply to your Luna Grill gift card, whether issued in electronic, physical or other form (“Gift Card”). Any time you purchase or use a Gift Card, you agree to these Terms and Conditions.

  1. About Gift Cards

Gift Cards are issued by Luna Grill. When purchasing a Gift Card, you will choose the dollar value for the Gift Card. Gift Card balances are not insured by the Federal Deposit Insurance Corporation (FDIC) and does not earn interest. Unless otherwise required by law or permitted by these Terms and Conditions, funds on a Gift Card are nonrefundable and may not be redeemed for cash.

Gift Cards are not intended for purchase or use by anyone under the age of 18. If you are under the age of 18, you may only use Gift Cards under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.

  1. Purchasing a Gift Card

You can purchase a Gift Card from any Luna Grill location that sells Gift Cards, or by going online to https://lunagrill.com/gift-cards/ and selecting “Send an E-Gift Card” or “Mail a Traditional Gift Card.” Gift Cards should be treated like cash by the holder. There may be a delay from the time you purchase a Gift Card and those funds being available for use by the recipient, or their receipt of a mailed gift card. The minimum purchase amount for a Gift Card is $5. You may not purchase a Gift Card for more than $500. You may not purchase more than $10,000 in total Gift Cards on any given day at any time.

Gift Card are non-reloadable. This means that, once you have spent all funds on a Gift Card, you cannot load additional funds on the Gift Card or re-use the Gift Card for additional purchases.

When purchasing a Gift Card, you agree to provide complete and accurate information about yourself or the recipient. If you do not provide complete or accurate information, or if we reasonably suspect that you have not provided complete or accurate information, we shall have the right, in our sole and absolute discretion, to disable the Gift Card and you will not be eligible for a refund of any remaining balance.   1. Using a Gift Card

The Gift Card is accepted at all Luna Grill locations, and may be used to make purchases at Luna Grill locations, on the Luna Grill app, and for catering orders.

You should treat Gift Cards like cash and not disclose any Gift Card information to anyone. You are responsible for maintaining the confidentiality and security of Gift Cards and Gift Card information. If your Gift Card or Gift Card information is lost or stolen, anyone who obtains possession of either may use your card. You are responsible for all transactions on your Gift Card, including unauthorized transactions. Luna Grill has no liability to you for any third-party fraud or unlawful activity associated with any Gift Card.

We reserve the right to not accept or otherwise reject presentment of any Gift Card.  We may at any time restrict what or how much you may purchase with a Gift Card, or how frequently you may use a Gift Card, if we reasonably believe that such use may be unauthorized, fraudulent or otherwise unlawful, and we consider such action appropriate to limit our risk. If Luna Grill discovers any Gift Card was purchased, sourced or derived from fraud or other unlawful means, we may in our sole discretion, cancel all impacted Gift Cards without notice to you. Extent to the extent prohibited by law, we may use retained Gift Card balances from such impacted Gift Cards to help offset our liability to third parties.

  1. No Fees and No Expiration of Funds

There are no delivery, handling, transaction or other charges or fees when purchasing or using a Gift Card. You only pay for the face value of the Gift Card. Gift Cards have no expiration date. Gift Card funds do not expire.

  1. Communications

You agree that we may provide notices, disclosures and amendments to these Terms and Conditions, and other information relating to a Gift Card by electronic means, including posting such materials online at https://lunagrill.com/gift-cards/.

  1. Receipts and Transaction History

When you use a Gift Card, we will provide a receipt if you request one. The receipt will indicate that the purchase was made using a Gift Card.. To check your gift card balance at any time, go to https://lunagrill.com/gift-cards/ and click “Check Your Balance.” When prompted, enter the gift card identification number.

  1. Errors and Disputes

If you have questions regarding any Gift Card transaction, or if you want to dispute a transaction made with a Gift Card, please email info@lunagrill.com or call (858) 450-1188. Assuming you provide us with sufficient details to investigate the transaction or dispute, we will review your claim and tell you the results of our investigation. If we determine there was an error, we will promptly correct the error after we finish our review.

Please read the Luna Grill Privacy Policy at https://lunagrill.com/legal-privacy/ carefully to understand how Luna Grill collects, uses, and discloses information about customers and how we communicate with you.

  1. Changes or Termination of these Terms and Conditions

We may amend these Terms and Conditions at any time. We will post the amended Terms and Conditions to our website at https://lunagrill.com/gift-cards/. As permitted by applicable law, any change, addition or deletion will become effective at the time we post the revised Terms and Conditions to our website. Unless we state otherwise, the change, addition, or deletion will apply to future and existing Gift Cards.

We may suspend or terminate these Terms and Conditions, and revoke or limit any or all of the rights and privileges granted to you at any time without notice or liability. If we terminate these Terms and Conditions without cause, we will refund or issue store credits equal to the balance on your cancelled Gift Cards.

If we find that you are in breach of these Terms and Conditions, we reserve the right to disable your Gift Card and you will not be eligible for a refund of any remaining balance.

  1. Arbitration

Please read this section carefully. It affects rights that you may otherwise have. It provides for resolution of most disputes through arbitration instead of court proceedings. Arbitration is more informal than a lawsuit in court, uses a neutral arbitrator instead of a judge or jury, and discovery is more limited. Arbitration is final and binding and subject to only very limited review by a court. This arbitration clause shall survive termination of these Terms and Conditions.

Binding Arbitration. This provision is intended to be interpreted broadly to encompass all prior, current, or future disputes or claims arising out of or relating to these Gift Card Terms and Conditions, your Gift Card and your relationship with us. Any dispute or claim arising out of or relating to these Terms and Conditions or use of the Gift Card and your relationship with Luna Grill or any subsidiary, parent or affiliate company or companies (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration, except that either of us may take claims to small claims court if they qualify for hearing by such a court.

Dispute Resolution Procedures. For all disputes, whether pursued in court or arbitration, you must . You and we each agree to negotiate your claim in good faith. You may request arbitration if your claim or dispute cannot be resolved within 60 days.

The arbitration of any dispute or claim shall be conducted in accordance with the rules of the American Arbitration Association (“AAA”), including the AAA’s Consumer Arbitration Rules (as applicable), as modified by these Terms and Conditions. The AAA Rules and information about arbitration and fees are available online at www.adr.org. You and we agree that these Terms and Conditions evidences a transaction in interstate commerce and this arbitration provision will be interpreted and enforced in accordance with the U.S. Federal Arbitration Act and federal arbitration law. Any arbitration will be held in a reasonably convenient location in the state in which you reside or at another mutually agreed location. The arbitration will be conducted in the English language. An arbitrator may award on an individual basis any relief that would be available in a court, including injunctive or declaratory relief (including public injunctive relief) to the extent required to satisfy your individual claim, and must follow and enforce these Terms and Conditions as a court would. Any arbitration shall be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction.

Costs of Arbitration. Upon filing of the arbitration demand, we will pay all filing, administration and arbitrator fees other than the initial $200 filing fee, and for claims of less than $1,000, Luna Grill will reimburse you for the filing fee within 30 days of receiving a written request from you. Each party will bear the fees and expense of its own attorneys, experts, witnesses and preparation and presentation of evidence at the arbitration. However, for claims under $10,000 as to which you provided notice and negotiated in good faith as required above before initiating arbitration, if the arbitrator finds you are the prevailing party in the arbitration, you will be entitled to a recovery of reasonable attorneys’ fees and costs. Except for claims determined to be frivolous, we agree not to seek an award of attorneys’ fees in arbitration even if an award is otherwise available under applicable law.

Class Action Waiver and Jury Waiver. You and we each agree that any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, consolidated or representative action. If a court or arbitrator determines in an action between you and us that this class action waiver is unenforceable, the arbitration agreement will be void as to you. If for any reason a claim proceeds in court rather than through arbitration, you and we each waive any right to a jury trial.

  1. Governing Law – California

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California notwithstanding any conflict of law rules.

  1. Disclaimers and Limits of Liability

Neither Luna Grill nor any of its affiliates make any representations, warranties or conditions of any kind, express or implied, with respect to the Gift Card, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement, or any warranty arising by usage of trade, course of dealing or course of performance. Luna Grill does not represent or warrant that a Gift Card will always be accessible or accepted.

In the event that Luna Grill or its affiliates are found liable to you, you shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on your Gift Card. Luna Grill and its affiliates shall have no liability for any incidental, indirect or consequential damages (including without limitation loss of profit, revenue or use), or any punitive or exemplary damages arising out of or in any way connected with these Terms and Conditions, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, even if we or our authorized representatives have been advised of the possibility of such damages. In no event shall Luna Grill or its affiliates have any liability for unauthorized access to, or alteration, theft or destruction of a Gift Card through accident, misuse or fraudulent means or devices by you or any third party, or as a result of any delay or mistake resulting from any circumstances beyond our control.

The laws of certain states or other jurisdictions do not allow limitations on implied warranties, or the exclusion or limitation of certain damages. If these laws apply, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you may have rights in addition to those contained in these Terms and Conditions. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

  1. Assignment

You may not assign these Terms and Conditions without our prior written consent and any attempted assignment will be void. We may assign all or part of these Terms and Conditions without notice to you. Our rights under these Terms and Conditions apply to us and each of our successors and assigns. Upon assignment by us, we are released from all liability.

  1. Entire Agreement, Construction

These Terms and Conditions represent the complete and exclusive statement of agreement between you and Luna Grill, and supersedes all prior proposals and other agreements governing Gift Cards (not including the Luna Grill Privacy Policy https://lunagrill.com/legal-privacy/). If any provision of these Terms and Conditions, other than the Class Action Waiver in the Arbitration provision above, is determined to be illegal or unenforceable, that provision will be eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect and enforceable.
